2. ACCEPTANCE OF TERMS
By connecting to this Wi-Fi network, you confirm that you:
- Are aged 13 or older (or 16 or older within the European Union, unless a lower national minimum age applies in your member state)
- Have read and understood these Terms
- Agree to be legally bound by them
If you do not agree, you must not use this service. Where you are under the applicable minimum age, you must obtain consent from a parent or guardian before submitting any personal data.

3. DESCRIPTION OF SERVICE
CaptiFi provides Wi-Fi captive portal and guest marketing technology to venues and businesses ("Venues"). When you connect to Wi-Fi at a Venue, CaptiFi acts as a technology provider on behalf of that Venue.
Wi-Fi access is provided "as is" and "as available" with no warranty of:
- Continuous availability or uptime
- Minimum speed or performance
- Fitness for any particular purpose
- Freedom from interruption or error

4. ACCEPTABLE USE POLICY
You agree to use this service only for lawful purposes. You must NOT:
(a) Access, download, or distribute illegal, offensive, abusive, defamatory, or obscene material;
(b) Harass, bully, or threaten any person;
(c) Send spam or unsolicited commercial communications;
(d) Access or attempt to access systems, accounts, or data without authorisation;
(e) Conduct port scanning, network attacks, or denial-of-service attacks;
(f) Circumvent security measures or access controls on any network;
(g) Engage in or facilitate illegal activity including hacking, fraud, or identity theft;
(h) Download, stream, or share copyright-infringing material via P2P, torrents, or similar methods;
(i) Use VPNs or anonymisation tools to circumvent these Terms or applicable law;
(j) Interfere with the network, its infrastructure, or other users' connections;
(k) Resell or commercially exploit access to this service without written consent;
(l) Transmit malware, spyware, ransomware, or any malicious code.
Violation of this Acceptable Use Policy may result in immediate termination of access, notification to law enforcement, and/or legal action.

5. FAIR USE AND BANDWIDTH
Wi-Fi is a shared resource. CaptiFi and the Venue reserve the right to:
- Apply bandwidth limits or traffic management at any time
- Prioritise or deprioritise certain types of traffic
- Restrict or terminate access for users consuming excessive bandwidth

6. SESSION DURATION
Wi-Fi sessions may be subject to time limits set by the Venue. On expiry, you may be required to re-authenticate. CaptiFi is not responsible for session termination or interruption.

7. DATA COLLECTION AND PRIVACY
Your personal data is collected and processed in accordance with our Privacy Policy, which forms part of these Terms. By connecting, you confirm you have read and understood the Privacy Policy.

8. COOKIES AND TRACKING

(b) Neither CaptiFi nor the Venue shall be liable for:
- Loss of data or information
- Loss of profits, revenue, or business
- Indirect, incidental, special, or consequential damages
- Device damage caused by malware or network attacks encountered while using the service
(c) Where liability cannot be excluded by law, total liability shall not exceed £100 (or the equivalent in your local currency).
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

12. INDEMNIFICATION

13. SERVICE AVAILABILITY
CaptiFi may modify, suspend, or discontinue the service at any time without notice. We are not liable for any consequences of such changes.

14. TERMINATION OF ACCESS
CaptiFi or the Venue may immediately restrict or terminate your access if:
- You breach any of these Terms

15. ADVERTISING AND COMMERCIAL CONTENT
The splash page may display promotional content or advertisements relevant to the Venue. By using the service, you acknowledge that such content may be displayed.

16. VENUE-SPECIFIC RULES

17. MODIFICATIONS TO THESE TERMS
CaptiFi may update these Terms at any time. Material changes will be communicated via email (where we hold your address) or via the captive portal on your next connection. Continued use constitutes acceptance.

18. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales. Mandatory consumer protection laws in your local jurisdiction also apply and are not excluded:

- Canada: PIPEDA and applicable provincial law apply

(c) Review targeting — identifying guests likely to leave a positive review based on visit patterns, to trigger Google Review requests at optimal times.
(d) Birthday reward automation — using date of birth to send time-sensitive personalised birthday messages.
(e) Segment-based marketing — automatically including or excluding guests from campaigns based on demographic and behavioural data (e.g. "female guests aged 25-40 who visited in the last 30 days").
These profiling activities determine only what marketing communications (if any) you receive from the Venue. They do not produce legal or similarly significant effects on you.
